Right of withdrawal for consumers 

As customers of the provider, consumers are entitled to a statutory right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.

We ask you to check the delivery for accuracy within 24 hours. Later complaints will not be accepted!

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
Alternative dispute resolution: The withdrawal period is 14 days from the day,

– on which you or a third party designated by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered as a single shipment;

– on which you or a third party designated by you, who is not the carrier, took possession of the last goods, provided that you ordered several goods as part of a single order and these are delivered separately;

– on which you or a third party designated by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered as a single shipment;

– on which you or a third party designated by you, who is not the carrier, took possession of the first goods, provided that goods are delivered for regular delivery over a specified period of time as part of an order.

To exercise your right of withdrawal, you must inform us (MELIUS GmbH, Stefan-George-Ring 2, 81929 München, Telefonnr.: 0821 71049409, E-Mail-Adresse: mail@newtobacco.de) by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us immediately and in any case no later than 14 days from the date on which you notify us of your withdrawal from this contract. You shall bear the direct costs of returning goods that can be shipped by parcel post, as well as the direct costs of returning goods that cannot be shipped by parcel post, in the amount of EUR 6.90.

You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

Reasons for exclusion or termination

The right of withdrawal does not apply to contracts

– for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
– for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
– for the delivery of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
– for the delivery of newspapers, magazines, or illustrated magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

– for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
– for the delivery of goods if, due to their nature, they have been inseparably mixed with other goods after delivery;
– for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been broken after delivery.
